Arbitration

The language to be used in the arbitral proceedings shall be English. The arbitration shall be kept confidential and the existence of the arbitration proceedings and any element of it (including but not limited to any pleadings, briefs or other documents submitted or exchanged and any testimony or other oral submissions and awards) shall not be disclosed beyond the arbitration tribunal, the parties, their legal representatives, and any person necessary for the conduct of the arbitration.
The arbitrator shall have the power to grant any remedy or relief that a court of competent jurisdiction sitting in Singapore could grant, including the award of monetary damages, specific performance, and injunctive relief, and the arbitral decision may be enforced in any court of competent jurisdiction. The award rendered by the arbitrator shall be final and binding on the parties.
The Terms and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of Singapore, exclusive of conflict or choice of law rules.
